Note: The amount in dispute is the basis for calculation of the arbitration fees. The segments in the above table are progressive. Hence, the fee resulting per segment under this table must be added to the fee(s) resulting from the previous segments, and so on, if pertinent, given the amount in dispute.  

The above table will apply to international arbitral tribunals comprised of one single arbitrator. When the tribunals are comprised of three arbitrators, the above fees may be increased, but by no more than thrice the fee of one arbitrator.

The arbitral tribunal will set its fees within the margins resulting from application of the above table, which must be submitted by the tribunal to approval by CAM Santiago at any stage in the arbitration proceedings. In making its decision, CAM Santiago will take into account, when necessary, information such as the estimated duration of the arbitration demand, its degree of complexity, how efficiently it was handled and other relevant circumstances.

When the amount in dispute does not appear to have been made sufficiently clear by the information that the parties have furnished to the arbitral tribunal, the tribunal will be the one to decide on that amount according to the circumstances mentioned in the previous paragraph and any other that is relevant. After the amount has been determined, the arbitral tribunal will set the corresponding fees according to the above table, which it should then submit to the approval of CAM Santiago.

The arbitral fees resulting from application of the above table include taxes and levies assessable on the arbitrators

Amounts paid to the arbitrator do not include any possible taxes applicable to the arbitrator’s fees. Parties have a duty to pay any such taxes.

The above table will be used to calculate the administration fee charged by CAM Santiago for international arbitration, the minimum being US$ 2,500. The sum of US$ 2,500, or the equivalent in Chilean pesos on the day of payment, must be paid to CAM Santiago by way of administrative fee upon submitting the request for international arbitration. No international arbitration will be processed without this payment. This sum will be non-reimbursable and it will be credited toward the final administration fee.

Checks used to make payment of the CAM Santiago administration fee should be drawn in the name of Cámara de Comercio de Santiago. Bank wire transfers of fees must be made according to the instructions in the Fee Section at www.camsantiago.com. Instructions may also be requested by calling (56 2) 360-7015 or by e-mail to camsantiago@ccs.cl.

The costs and expenses of international arbitration are not included in the fees of the arbitral tribunal or in the administration fee of CAM Santiago. Those costs and expenses will be subject to the pertinent rules set down in the Rules of International Commercial Arbitration of CAM Santiago applicable to the respective arbitration.

The arbitral tribunal and CAM Santiago will have the authority to request that the parties furnish the sum they deem pertinent during the arbitration to defray expenses, fees and the administrative fee, taking into account the arbitrators’ fees and administrative fee.

Fees for Requests for the Appointment of International Arbitrators

A non-reimbursable fee of US$ 2,500 will be charged for the appointment of one or more international arbitrators requested from CAM Santiago in arbitration that will not abide by the Center’s Rules or be administrated by the Center. The fee payment must be furnished with the request.

This fee includes the procedure for appointment of the regular arbitrator and any substitute, should there be a recusation.

The arbitrators’ fees, administrative fee of CAM Santiago and arbitrator appointment fee will enter into effect on June 1, 2006 and apply to all international arbitration commencing on or after that date, regardless of the version of rules applicable to the arbitration.

The party filing a request for international arbitration by CAM Santiago should pay US$2,500 (two thousand five hundred U.S. dollars) for the CAM Santiago administrative fee. It can be paid in the following ways:

Once the deposit has been made, a copy must be sent of the bill or electronic deposit slip to camsantiago@ccs.cl or to fax 56-2-6333395, mentioning in particular the natural or juristic person who made the payment.

The initial administrative fee is non-reimbursable, but it will be credited towards the final administrative fee payable according to the international arbitration fees of CAM Santiago.
