The mediators' fees and the administrative fee of CAM Santiago came into effect on July 28, 2010 and apply to all mediations beginning at or after that date, notwithstanding the version of the Rules of Mediation Procedure to which the mediation is subject to.

Mediators' Fees

The mediator's fee will be 7 UF (Unidad de Fomento) per hour, with a minimum of 14 UF (Unidades de Fomento) and 1,75 UF for each additional fraction of 15 minutes.

If there is co-mediation (two mediators) requested by the parties, each mediator will receive 7 UF per hour with a minimum of 14 UF.

Bank checks to the mediators for their fees must be extended to their name and sent to the CAM Santiago at the end of the mediation process.

Amounts paid to the mediator do not include any taxes applicable to the mediator’s fees. Parties have a duty to pay any such taxes.

CAM Santiago Mediation Administration Fee

The administration fee that CAM Santiago charges is 10% of the mediator(s) fee(s), with a minimum of 14 UF (Unidades de Fomento).

Upon requesting the mediation, the soliciting party must pay the administrative fee of 7 UF (Unidades de Fomento) to CAM Santiago, in the equivalent in pesos on the day of payment.  No mediation request will be processed before this payment.  If the other party or parties agree to mediation, they should also pay the remaining 7 UF ( Unidades de Fomento) in equal proportions.  These sums will not be reimbursed, and will be allocable to the final administrative fee.  If the other party or parties do not agree to participate in the mediation, the amount paid by the requester will not be reimbursed.  If the mediation request is presented by all parties in the dispute, all shall pay the total minimum administrative fee of CAM Santiago in equal proportions.

Any bank check used to make payment must be issued to “Cámara de Comercio de Santiago ”.

CAM Santiago will have the right to request that the parties provide an amount of funding that it deems pertinent during the course of the mediation to defray expenses, fees and the administrative fee. Unless otherwise agreed by the parties, the mediation fees and administrative fee will be paid in equal proportions by the parties.

Any other expense resulting from the mediation process, such as expert opinions, transportation or the like will be paid by the parties proportionally, unless otherwise agreed. Any disagreement between one or more of the parties and CAM Santiago on the amount of the mediator's fees may be brought before the Center's Council for a final decision.
